COMMERCIAL AND/OR NEWS MEDIA PURPOSES ARE BROADLY DEFINED AS USE ON ANY AND ALL PLATFORMS— EXISTING OR OTHERWISE— INCLUDING BUT NOT LIMITED TO PRINT, DIGITAL, ONLINE, MOBILE APPLICATIONS, RADIO, TV, BILLBOARD, BLOG, AND/OR SOCIAL MEDIA (INCLUDING, BUT NOT LIMITED TO, THE PERSONAL AND/OR PROFESSIONAL SOCIAL MEDIA ACCOUNTS OF ANY AND ALL EMPLOYEES, CONTRACTORS, GUEST SPEAKERS/WRITERS AND/OR SOURCES OF A NEWS MEDIUM.) (Basically, if you’re any person or politician trying to get your 15 minutes of fame by creating controversy about drag queens or the LGBTQ+ community, move on.)

By using this ticket, ticketholder (“Holder”) agrees to the terms and conditions stated herein (the “Agreement”). Holder is admitted on the condition, and by use of this ticket, Holder agrees on behalf of Holder that: (a) Holder shall not transmit or aid in transmitting, or make or aid in the making of any commercial and/or newsuse of, any information about the show to which it grants admission including, without limitation, any account, description, picture, video, audio, reproduction, or other information concerning or in connection with the show, the entertainers, or the venue (the “Show Information”); (b) Texas International Productions, LLC dba BestDragShows.com (the “company”) is the exclusive owner of all copyrights and other proprietary rights in the show and Show Information; and (c) the venue (collectively, the “Entities”), and each of their respective agents and licensees, shall have the unrestricted right and license to use Holder’s and any guest’s name, image, likenesses, voice, comments, or other proprietary or public rights in any live or recorded broadcast, telecast, photograph, video, audio sound, audiovisual, and/or other recording taken in connection with the show or other transmission, distribution, public performance, or reproduction in whole or in part of the show, for all purposes, worldwide, in perpetuity, and in any and all media now or hereafter known without consent, compensation, or further notice. The rights granted herein to the Company and the  Entities are freely assignable. Breach of any of the foregoing by Holder will automatically terminate this license and may result in further legal action.

The Company reserves the right to revoke the license granted by this ticket for any reason by tendering to Holder any monies paid by Holder to the Company for the ticket, excluding service charges. Holder is subject to all rules and policies of the Company including those set forth herein and all applicable federal, state, and local laws, rules, policies, and regulations (collectively, “Laws”) including those of the Entities, City, and County of show location. The Company reserves the right, without refund of any portion of the purchase price of this ticket, to revoke the license granted by this ticket and refuse admission or eject any person that the Company deems to be in violation of the such Laws or the safety of staff, entertainers, and/or patrons. Holder consents to security searches and/or screening including allowing the Company and/or their designees to inspect Holder’s person and any bags, clothing, or other articles for security purposes, by any means determined by the Company. Any dispute, claim, or cause of action regarding the terms of this ticket, attendance at a show, or any related activities, or sales or resales of a ticket, shall be brought (i) individually, without resort to any form of class or collective action, and without joinder or consolidation of claims of third parties, and (ii) exclusively before a single, private, impartial arbitrator in a confidential, final, and binding arbitration held in Dallas, Texas administered by the American Arbitration Association under its then current Commercial Arbitration Rules. The arbitrator shall have the power to award any remedies available under applicable law. Any award and any confirming judgement applies only to the arbitration in which it was awarded and cannot be further used in any other case except to enforce the award itself. This ticket may not be used for advertising, promotion (including contests, sweepstakes, raffles, or giveaways), or other trade or commercial purposes without the express written consent of the Company. This ticket may not be resold or offered for resale in a manner, at a price, or otherwise in violation any Laws; any such resale will invalidate the license granted by this ticket.

COVID-19 NOTICE

COVID-19 IS AN EXTREMELY CONTAGIOUS DISEASE THAT CAN LEAD TO SEVERE ILLNESS AND DEATH. AN INHERENT RISK OF EXPOSURE TO COVID-19 EXISTS IN ANY PUBLIC PLACE REGARDLESS OF PRECAUTIONS THAT MAY BE TAKEN. HOLDER, ON THEIR BEHALF AND ON BEHALF OF ANY ACCOMPANYING PARTIES (AS DEFINED BELOW), AGREES TO (1) ASSUME ALL RISKS ASSOCIATED WITH COVID-19 AND OTHER COMMUNICABLE DISEASES, AND (2) COMPLY WITH ALL RELATED HEALTH & SAFETY POLICIES OF THE COMPANY AND THE DISTRICT.

Holder, on their behalf and on behalf of any accompanying party for whom Holder retains a ticket to attend the show or event governed by the Agreement (“Event”) with Holder (each of whom Holder represents have authorized Holder to act on their behalf in accepting the applicable ticket terms) (together with any Minor, “Accompanying Parties”), acknowledges and agrees to comply with (1) all relevant policies and protocols issued by the Company and/or the venue, including, without limitation, any policies and protocols regarding security, bags, attendee conduct and health and safety, all of which, due to the evolving nature of the COVID-19 pandemic, may continue to be updated from time to time between purchase of this ticket and the Event date, and (2) all current guidance of the Centers for Disease Control and Prevention and all applicable Laws.

GUEST HEALTH PROMISE

Holder acknowledges and understands that, if infected with COVID-19 or other Communicable Disease (as defined at the conclusion of this paragraph), Holder and/or any Accompanying Parties may infect others that they may subsequently come in contact with, even if they are not experiencing or displaying any symptoms of illness, and that the risk of exposure to others remains at all times. Accordingly, Holder agrees that neither Holder nor any Accompanying Party will attend the Event if within ten (10) days preceding the Event, they have:

(1) tested positive or presumptively positive for COVID-19 or other Communicable Disease or been identified as a potential carrier of COVID-19 or other Communicable Disease; OR

(2) experienced any symptoms commonly associated with COVID-19 or other Communicable Disease; OR

(3) been in direct contact with or the immediate vicinity of any person who is confirmed or suspected of being infected with COVID-19 or other Communicable Disease.

A “Communicable Disease” as used herein is COVID-19, any strains, variants, or mutations thereof, the coronavirus that causes COVID-19, and/or any other airborne, aerosolized, or surface transmissible communicable and/or infectious diseases, viruses, bacteria or illnesses or the causes thereof.

RESALE TERMS

Holder, on their behalf and on behalf of any Accompanying Parties, agrees to comply with all terms and conditions presented at the time of purchase not specifically enumerated herein, including without limitation (1) terms that mandate or prescribe the quantity of tickets available to be purchased, (2) additional requirements regarding Accompanying Parties, and (3) terms regarding the resale or transfer of tickets.

ASSUMPTION OF RISK RELATED TO COVID-19 AND OTHER COMMUNICABLE DISEASES

Holder, on their behalf and on behalf of any Accompanying Parties, acknowledges and expressly assumes all risks that are in any way related to or arising from being exposed to or contracting COVID-19 or other Communicable Disease at these events and surrounding areas, including parking lots (“Event Area”). By using this ticket, Holder is acknowledging and confirming, both now and in the future, that Holder understands and expressly assumes the risk that Holder and any Accompanying Party may be exposed to COVID-19 or other Communicable Disease. Holder expressly understands that these risks include contracting COVID-19 or other Communicable Disease and the associated dangers, medical complications and physical and mental injuries, both foreseen and unforeseen, that may result from contracting COVID-19 or other Communicable Disease. Holder further acknowledges and understands that any interaction with the general public poses an elevated, inherent risk of being exposed to and contracting Communicable Disease, including, but not limited to, COVID-19, that it cannot be guaranteed that Holder or any Accompanying Party will not be exposed, and that as such, potential exposure to or contraction of COVID-19 or other Communicable Disease are risks inherent in Holder’s decision to use this ticket that cannot be eliminated.

WAIVER AND RELEASE OF LIABILITY

HOLDER, ON BEHALF OF HOLDER, ANY ACCOMPANYING PARTY AND THEIR PERSONAL REPRESENTATIVES, ASSIGNS, HEIRS, NEXT OF KIN AND ANY OTHER PERSON OR ENTITY THAT MAY BE ENTITLED TO MAKE A CLAIM ON THEIR BEHALF, WAIVES, RELEASES, DISCHARGES, HOLDS HARMLESS, AND COVENANTS NOT TO SUE THE COMPANY, the OTHER   Entities, Texas International Productions LLC, event venues, event sponsors, the participating Companys and any and all other related entities, or their respective past, present, or future parent, subsidiary, or affiliate companies and their respective owners, partners, members, shareholders, officers, directors, employees, agents, staff, managers, entertainers, DJ’s, representatives, customers, purchasers, independent contractors, licensees, exhibitors, vendors, volunteers, successors, and assigns (collectively, the “Released Parties”) WITH RESPECT TO ANY CLAIM, LIABILITY, DAMAGE, COST, EXPENSE, OR DEMAND OF WHATEVER KIND OR NATURE, EITHER IN LAW OR IN EQUITY, THAT MAY ARISE IN CONNECTION WITH, OR RELATE IN ANY WAY TO, (A) USE OF THIS TICKET, (B) PRESENCE IN OR AROUND THE EVENT AREA OR RISKS AND DANAGERS INCIDENTAL TO THE SHOW INCLUDING, BUT NOT LIMITED TO, SPILLED FOOD AND/OR BEVERAGE ITEMS, SLIPS, FALLS, OR FRAGMENTS THEREOF, OR thrown, dropped, or launched items OR projectiles (including but not limited to from a firearm or other incendiary device) OR (C) PARTICIPATION IN ANY EVENT OR ANY RELATED ACTIVITIES ARRANGED, PROMOTED, AND/OR SPONSORED BY THE RELEASED PARTIES INCLUDING, WITHOUT LIMITATION, THOSE CLAIMS THAT ARISE AS A RESULT OF: (1) IN WHOLE OR IN PART, THE SOLE, JOINT, GROSS, OR COMPARATIVE NEGLIGENCE, OR STRICT LIABILITY, OF THE RELEASED PARTIES, AND/OR (2) THE INHERENT RISKS ASSOCIATED WITH VISITING THE EVENT AREA, INCLUDING, WITHOUT LIMITATION (X) ALL CLAIMS FOR PERSONAL INJURIES, DAMAGE TO PROPERTY, WRONGFUL DEATH, OR EXPOSURE TO OR CONTRACTION OF COVID-19 OR OTHER COMMUNICABLE DISEASE BY HOLDER, ANY ACCOMPANYING PARTY, OR OTHER INDIVIDUALS EXPOSED TO COVID-19 OR OTHER COMMUNICABLE DISEASE BY HOLDER OR ANY ACCOMPANYING PARTY; AND (Y) ALL CLAIMS IN CONNECTION WITH THE APPLICATION OF ANY HEALTH AND SAFETY PROTOCOLS TO HOLDER OR ANY ACCOMPANYING PARTY. *BY ATTENDING THIS SHOW OR EVENT AND/OR USE OF THIS TICKET, HOLDER (ON BEHALF OF HOLDER AND ANY ACCOMPANYING PARTY) IS DEEMED TO HAVE GIVEN A FULL RELEASE OF LIABILITY TO THE RELEASED PARTIES. IF HOLDER DOES NOT WISH TO OR IS NOT AUTHORIZED TO GRANT ALL THE RIGHTS, RELEASES, AND WAIVERS SET FORTH IN THIS TICKET ON BEHALF OF ANY ACCOMPANYING PARTY, HOLDER SHOULD IMMEDIATELY ACCOMPANY THE ACCOMPANYING PARTY OUT OF THE EVENT AREA.

The acknowledgements and express assumptions of risk, waivers of claims, and releases of liability contained herein are intended to be binding and full waivers of claims and releases of liability, and interpreted to be as broad and inclusive as is permitted by law, including with respect to any controversy, claim or dispute that may arise related to exposure or contraction of COVID-19 or other Communicable Disease. If any part hereof is held to be invalid or legally unenforceable for any reason, the remainder of the Agreement shall not be affected thereby and shall remain valid and fully enforceable.

RAIN CHECK POLICY

Retain possession of this RAIN CHECK until the SHOW NUMBERED OR NAMED HEREON has been played to completion. The RAIN CHECK is only good for this particular show, and any rescheduled show or substitute show as provided below, and no part of the purchase price will be refunded by reason of the failure of Holder to use it for such shows. Should the SHOW NUMBERED OR NAMED HEREON not be performed or not progress to or beyond a point of one hour after Holder has been admitted to the Event Area, this RAIN CHECK will be honored at the re-scheduled show which replaces the SHOW NUMBERED OR NAMED HEREON. If unable to attend the re-scheduled show, Holder may exchange this RAIN CHECK for a ticket of the same value (subject to availability) for any show during the current regular season. Such exchanges must occur prior to five days of the rescheduled show. Complimentary tickets have a value of zero dollars and therefore may not be exchanged. Complimentary tickets will be honored at the rescheduled show only. Discounted tickets may be exchanged only for the amount paid to the Company and are subject to any constraints applicable to the original sale. There will be no RAIN CHECK or exchange for a show which is delayed (whether for weather or power delays or otherwise), but which progresses to or beyond a point of one hour.
